Terms of Service

These Terms of Service (the "Terms") govern the use of all services provided by VoxVoice (the "Company"), consisting of a wide range of virtual telephony and communication features as described on the Company's website (the "Services").

These Terms apply to and govern all Services provided by the Company to its customers.

By accessing or using the Services, opening an account, registering with the Company, or contacting customer support, you agree to be legally bound by these Terms. If you do not agree, you must not use the Services. Any violation of these Terms may result in immediate action by the Company, including suspension or termination of Services or legal action.

For purposes of these Terms, "Company," "VoxVoice," "we," "us," or "our" refers to VoxVoice and its affiliates, officers, directors, employees, agents, contractors, successors, and assigns. "Customer" or "you" refers to any individual or legal entity using the Services, including its users, agents, employees, contractors, partners, or resellers.

ACCOUNT

Minimum Deposit

A minimum prepaid deposit of USD $15.00 is required to activate Services.

Number Testing and Technical Information

Customers must verify and test any number delivered to their account before public use. Testing must be performed from a landline or mobile carrier. Non-functional numbers will be removed and refunded and may be replaced upon request.

Technical documentation is provided for reference and convenience. VoxVoice endeavors to keep documentation current, but does not guarantee it reflects the most recent implementation of the Services.

Residential Account Limitations

To comply with regulatory and internal service classifications, Residential accounts are subject to the following limitations:

  • Call volume limits
  • Maximum number of active DIDs
  • Monthly funding limits
  • Limits on simultaneous outbound call channels

If a Customer believes their usage exceeds typical residential use, they must notify Customer Support. VoxVoice may reclassify or impose additional requirements at its sole discretion.

RATES

Rates

Rates are valid only when published. Customers must verify current pricing before use.

Flat-Rate Plans

Flat-rate or unlimited DID plans for the United States and Canada are intended for residential use only and include limited simultaneous channels and monthly inbound minute caps.

Payphone Charges

Calls originating from payphones may incur additional surcharges imposed by upstream carriers. These charges may be billed retroactively, and Customers remain responsible for all account usage.

Toll-Free Usage

Toll-free traffic must remain ancillary to normal call traffic. VoxVoice reserves the right to restrict or disable toll-free services if usage ratios are excessive or abusive.

Porting Fees

Porting out fees? wth is that?

Port-in fees may apply for resubmissions, cancellations, or expedited requests.

Billing Increments

Certain international destinations are billed in 60-second increments with a minimum of 60 seconds. All other destinations are billed in 6-second increments with a 6-second minimum.

BILLING AND PAYMENT

Account Balance

Customers are responsible for all usage and maintaining sufficient funds. Accounts may temporarily incur a negative balance. VoxVoice reserves the right to suspend accounts below required minimum balances after notice.

Account Closure for Negative Balance

Accounts remaining in negative balance for two (2) consecutive weeks may be closed following notice, and Services disconnected or repurposed.

Refund Policy

Unused balances funded within the prior ninety (90) days may be refunded. Funds older than ninety (90) days are non-refundable but remain usable.

Automatic Billing

Customers may enable automatic billing with a minimum threshold of USD $15.00. VoxVoice does not guarantee uninterrupted automatic billing.

CUSTOMER RESPONSIBILITIES

Customers agree to:

  • Maintain accurate Caller ID information
  • Secure account credentials
  • Comply with FCC and other applicable regulations
  • Respond promptly to traceback requests

Traceback Requests

Customers acting as originating or transit providers must fully cooperate with authorized traceback investigations and respond in good faith without requiring subpoenas.

Business Messaging

U.S. SMS/MMS campaigns must be registered with The Campaign Registry. Unregistered traffic may be blocked or fined.

Reselling Services

Resellers represent that they hold all required licenses and registrations and agree to indemnify VoxVoice for all claims arising from resale activities.

TELEMARKETING & SHORT CALLS

Telemarketing or short-duration calling requires prior written authorization. Unauthorized activity may result in immediate suspension without notice.

PERSONAL INFORMATION

VoxVoice does not sell personal data. Customer data may be processed or hosted by authorized third-party providers in accordance with the Privacy Policy.

Customers are responsible for safeguarding login credentials. Two-factor authentication is strongly recommended.

Information may be disclosed when required by law or lawful governmental request.

INTELLECTUAL PROPERTY & COMMUNICATIONS

All Services, software, and documentation remain the exclusive property of VoxVoice. No ownership rights are transferred.

Customers broadcasting music through queue features warrant that they hold all required licenses and agree to indemnify VoxVoice.

Customer feedback becomes the exclusive property of VoxVoice.

ACCEPTABLE USE & SECURITY

VoxVoice maintains a zero-tolerance policy for spam, SPIT, and unlawful activity. Violations may result in immediate suspension or termination.

Security screening may be performed using third-party risk assessment services.

RECORDINGS & TRANSCRIPTION

Customers using call recording or transcription features are solely responsible for compliance with consent and notice laws and indemnify VoxVoice from all related claims.

WARRANTIES & LIMITATION OF LIABILITY

SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE." TO THE MAXIMUM EXTENT PERMITTED BY LAW, VOXVOICE DISCLAIMS ALL WARRANTIES AND SHALL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES.

ACCOUNT CLOSURE

Inactive accounts may be closed after twenty-four (24) consecutive months following notice.

EMERGENCY SERVICES (911)

VoIP emergency calling has inherent limitations and may fail due to power or connectivity issues. Customers assume all risks and responsibilities and agree to maintain alternative access to emergency services.

Improperly configured or unregistered emergency calls may incur carrier-imposed fees, including a $75.00 per-call charge.

Customers are responsible for compliance with all applicable emergency-calling regulations and for informing end users of limitations.

GOVERNING LAW & DISPUTE RESOLUTION

These Terms are governed by the laws of the United States and the State of Oregon, without regard to conflict-of-law principles. Exclusive venue lies in state or federal courts located in Oregon. Jury trial is waived to the extent permitted by law.

GENERAL PROVISIONS

These Terms constitute the entire agreement between the parties. VoxVoice may amend these Terms at any time, and continued use constitutes acceptance.

Services are available only to individuals of legal age and entities with legal capacity to contract.
